Topcret USA / Terms & Warranty
Topcret USA sets its own conditions of sale, warranty and technical support. This page explains what we cover, what we don't, and which information is valid.
Topcret USA LLC ("Topcret USA") is Official U.S. Distributor of Topcret. We supply EcoCemento®, Baxab®Eco, Real Metals®, Clay® and the T/Grip textured finish option, on commercial terms defined by Topcret USA for the United States.
Topcret USA honors the manufacturer's 3-year warranty against product manufacturing defects only. Within that period, defective material is repaired or replaced under the program's terms. This warranty applies to the product itself — it does not cover installation, workmanship, substrate conditions, or wear from use, misuse or inadequate maintenance.
Installation is warranted solely by the company or professional who performs it. Topcret USA does not provide, assume or share any installation warranty, directly or collaterally.
This includes substrate evaluation and preparation, which — as stated in our Substrate Preparation Guide — are the sole responsibility of the installer or contractor. Topcret USA is not responsible for results affected by substrate condition, moisture, leveling, waterproofing or workmanship.
Every system is installed 100% by hand. Because the work is artisanal, the color, texture and movement of each project are unique and cannot be reproduced exactly. Physical samples, color charts, photographs on this website, and images on our social media are for reference only and do not represent the exact final result of any project.
Microcement systems are not a waterproofing system; wet areas require an approved, rigid waterproofing membrane beneath the finish. Breathability depends on the protective sealer specified for each project; Baxab®Eco is not breathable. Topcret USA supplies Clay® and Real Metals® for interior walls, ceilings and furniture only, and does not supply or support pool-interior systems.
Topcret USA provides guidance on system selection, approved surfaces and substrate preparation. This guidance is advisory; final responsibility for site conditions and installation rests with the installer or contractor.
EcoCemento®, Baxab®, Clay® and other product names are registered trademarks of Topcret, used by Topcret USA as Official U.S. Distributor of Topcret.
Trial kits and products are supplied for professional use only. The final result obtained with any kit or product depends entirely on the substrate, preparation, tools, technique, jobsite conditions and skill of the person installing it. Topcret USA makes no warranty — express or implied — as to the appearance, texture, color, performance or suitability of any result produced by the buyer. The buyer is solely responsible for the use of the kit and its results. Dissatisfaction with a self-produced result is not a product defect and is not grounds for a return, refund, credit, chargeback or dispute. This does not affect the manufacturer's limited product-defect warranty described in Section 2, which covers manufacturing defects in the product itself only.
By purchasing, the buyer agrees that delivery and/or use of a product completes the sale. Filing a chargeback or payment dispute for a product that was delivered — or on the basis of a result the buyer produced with it — is a breach of these conditions and an invalid dispute. Topcret USA reserves the right to contest any such dispute using the order record, proof of delivery, tracking, communications and these conditions, and to recover related costs. Suspected fraudulent disputes may be reported to the card network and to the appropriate authorities.
Orders ship through independent third-party carriers (such as UPS, FedEx and DHL). Once a package is handed to the carrier, its handling, transit and delivery are outside Topcret USA's control. Risk of loss or damage passes to the buyer when the carrier takes possession of the package, and Topcret USA is not responsible for carrier delays or for the condition in which a carrier handles or delivers a package.
The buyer must inspect every package at the moment of delivery. If a package arrives damaged, crushed, opened, wet or otherwise compromised, the buyer must refuse delivery and notify Topcret USA at info@topcretusa.com within 48 hours. Topcret USA will then file a claim with the carrier on the buyer's behalf. Topcret USA cannot process or support a shipping-damage claim if the buyer accepted a visibly damaged package or failed to notify Topcret USA within this window.
